Terms and conditions of car rental in Cuba

 

By sending a written booking to CubaFista you agree to accept the following terms and conditions.

Booking and payment procedures (all technical and safety details) are regulated by the law, which must be followed by both parties (Client and CubaFiesta).

 

Car rental - booking procedure

Car rental services must be booked at least 8 bank days prior to departure. Only written bookings are acceptable by CubaFiesta.

All requests will be processed immediately and you will be contacted.

 

Car rental - payment procedure


After the rental is confirmed/denied by provider CubaFiesta sends you information on the status of the booking. In case of confirmation it contains the details of booking, information on payment and bank details. The method of payment is bank transfer. Upon payment it is essential that you make a note of the booking ID.

The full balance must be paid before the agreed payment date. You agree to pay all the bank charges that appear during the payment. You agree that if the payment is not made within 7 bank days of the booking or the full amount is not received by CubaFiesta, this might result the cancellation of your booking.

All other obligatory costs like deposit, insurance, fuel fee and the supplements like airport pick up, one way rental, extra days or second driver must be paid on the spot (in cash or with credit card not owned by any bank of the Unites States of America).

In case of price change and change of currency exchange rates CubaFiesta has the right to raise price of the service until the 20th day before Client's departure date. CubaFiesta sends written notification about the fact of it. If the raise in price exceeds the 8% of the total amount of the booking, Client can cancel the booking without penalty. Client must send a written cancellation to CubaFiesta within 3 days after receiving the notification.

 

Car rental - urgent booking


All bookings made less than 14 days prior to departure are considered urgent bookings. In this case you have to pay a 50 EUR urgent booking fee on top of the booking value, that is always included in total price. Plus you have to make an immediate bank transfer choosing the urgent option. Late and incomplete payments will not be accepted by CubaFiesta and will be returned immediately. In this case you will be liable for all bank charges.

CubaFiesta might be unable to complete bookings made less than bank 7 bank days prior to departure; therefore these bookings might be rejected.

 

Car rental - invoice, voucher


Before making the payment CubaFiesta will send you the invoice. When payment is completed you will also receive the voucher.  Service(s) can be used after showing up the printed voucher. The traveller(s) can only use the services listed on the voucher, and only the owner(s)of the voucher are entitled to drive the car.  The voucher is valid for continual rental period and cannot be divided into multiple periods. Voucher can only be used to get the service, it’s not part of the rental contract. If you decide not to use the service, you are responsible for paying all the costs caused by this and you can not apply for any compensation or refund.

 

Car rental - cancellation policy


The cancellation fee depends on the time of the cancellation: 30 days or more before departure: 10 EUR / booking (administration fee);  29 - 10 days before departure: 50% of the total booking amount; 9 - 0 days before departure: 100% of the total booking amount. If the traveller(s) fail to turn up on the day of departure CubaFiesta will charge a 100% of the total amount.

 

Third-party insurance during the rental period


The fee of the third-party insurance must be paid to the car rental company. The insurance is not optional; every client has to pay it. You have to check the retention. Insurance covers neither the damage of chassis, tires, windscreen, internal covering did caused through an oversight or in an intoxicated state, nor the damage arising from keys left in the car or the retention.

 

Driving licence

Driver must hold a valid driving licence. Age limit (if other is not stated in the rental contract): 21. International driving licence is not necessary.

 

Pick up

Before pick up you must present the voucher and sign the rental contract. Once the contract is signed it must be followed by both parties.
Before signing the rental contract Client must check the repair of the car and tyres, including fifth wheel. Any disorder must be reported to the staff of the rental office on the spot as CubaFiesta is not liable for the rental contract. If Client failed to check the car and a problem occurs, the rental company or Cubafiesta is no longer liable for that. Any refund of the rental fee is only available in case rental company can not provide the appropriate car category that Client booked and paid or in case rental company can not provide the car for the full length of the prepaid rental period. Client is obligated to report the problem to Cubafiesta in written (email, text message) immadiately. If Client fails to report the problem beause of technical errors  neither parties are responsible, the extra costs have to be paid by Client.
Cubafiesta is no liable for problems occured beause of the technical condition of the car.

Supplement applies: for a second-driver; for one-way rental in case the drop off is not done at an office listed by the contracted rental company.

Before leaving the rental office you have to check if you have all the necessary contact information of the rental company such as emergency number and list of offices. If you fail to check it Cubafiesta is no longer liable for the problems it can cause.

Not presenting the voucher or breaking the contract might result the cancellation of the booking and provider can refuse passing the car.

 

Fuel

You will pick up and must drop off the car with full tank - otherwise the car rental company will calculate the price of it according to its own tariffs (some companies ask for the fuel fee in advance so the car can be dropped off with empty tank).

You must fill the tank up with the suitable fuel - damages caused by the use of unsuitable fuel must be paid by you.

 

During the rental


You must pay the penalties, motorway fees, tire fixing and windscreen cleaning during the rental period. In case of an accident both police and car rental company must be reported. Accident insurance can be took out on the spot and it covers the treatment of injuries appeared during the rental period.

You must take care of the guarding, cleaning and service of the car during the rental. The obligatory service is free. Not taking the car to the service in time might cause the loss of deposit. Periodic service can be done at the services listed by the car rental company. Neither the rental company nor CubaFiesta takes responsibility of values left in the car.

 

Drop off

You must ask for a certificate of taking back the car in the original state with full tank.

In case of early drop off you can not ask for any refund. All responsibilities of car rental company are always according to the contract.

Lengthen of booking is possible (but not guaranteed) for the supplement calculated by the car rental company and paid on the spot.

 

Others - useful information

Make and size of engine is not guaranteed, car rental company must provide a car in the booked or higher category.

All cars are categorized according to the followings:

E> Economico> low performance and equipment, cars

M> Medio> medium performance and equipment, cars

MA> Medio Alto> high performance and extra equipments, cars

A> Alto> high performance and full -full equipment, cars

4x4T/L> Jeep> low performance, separable, soft roof, jeep

4x4T/D> Jeep> high performance, separable, hard roof, jeep

LP> Lujo Paseo> high performance and full equipment, cars

D> Deportivo> sport cars

MV> Minivan> family cars

V> Van> minibuses

 

Pictures of the cars are only illustration and cars can be different. CubaFiesta is not liable for complaints resultant from this reason!

 

Special situations

According to the civil rights neither parties are responsible in case of a strike, war and political conflict, danger to the public, disaster, terror attack, international embargo and extreme weather conditions. If any sevice fails because of any of these reasons Cubafiesta is not liable and you can not ask for any refund or compensation, all extra costs have to be paid by you.

 

Complaints

Complaints of unsatisfactory service (not the booked car category or not the booked length of rental period) must be reported and recorded at the time of occurrence at the rental company. Client must report the problem to Cubafiesta in written (email, text  message) on the day of pick up. If Cubafiesta can not solve the problem either, Client must prepare a written report on the problem that must be signed and stamped by rental office. The scanned report must be sent to Cubafiesta no later then 3 days after return of Client. Please consider that examination of your complaint can last for 3 - 6 months!

 

In case of a complaint

CubaFiesta aims to resolve all disputes directly with its clients. In case of a resolution cannot be reached CubaFiesta agrees with the submission of the dispute to arbitration.
