Terms and conditions of excursion booking in Cuba
By sending a written booking to CubaFista you agree to accept the following terms and conditions.
Booking and payment procedures (all technical and safety details) of excursions in Cuba are regulated by the law, which must be followed by both parties (Client and CubaFiesta).
Excursion booking procedure
Excursions must be booked at least 8 bank days prior to departure. Only written bookings are acceptable by CubaFiesta.
All requests will be processed immediately and you will be contacted.
Payment procedure of excursion booking
After the excursion is confirmed/denied by organizer CubaFiesta sends you information on the status of the booking. In case of confirmation it contains the details of booking, information on payment and bank details. The method of payment is bank transfer. Upon payment it is essential that you make a note of the booking ID. Please note that when signing the re-confirmation you agree to pay the bank costs of both parties.
The full balance must be paid before the agreed payment date. Payments must be made within 7 days after we confirm the service(s), if not ordered otherwise. You agree that if the payment is not made within 7 days of the booking or the full amount is not received by CubaFiesta, this might result in the cancellation of your booking.
In case of price change and change of currency exchange rates CubaFiesta has the right to raise price of the service until the 20th day before Client's departure date. CubaFiesta sends written notification about the fact of it. If the raise in price exceeds the 8% of the total amount of the booking, Client can cancel the booking without penalty. Client must send a written cancellation to CubaFiesta within 3 days after receiving the notification.
Urgent excursion booking
All bookings made less than 14 days prior to departure are considered urgent bookings. In this case you have to pay a 50 EUR urgent booking fee on top of the booking value, that is always included in total price. Plus you have to make an immediate bank transfer choosing the urgent option. Late and incomplete payments will not be accepted by CubaFiesta and will be returned immediately. In this case you will be liable for all bank charges.
CubaFiesta might be unable to complete bookings made less than bank 7 bank days prior to departure; therefore these bookings might be rejected.
Invoice, excursion voucher
Before making the payment CubaFiesta will send you the invoice. When payment is completed you will also receive the voucher.
The traveller(s) can only use the services listed on the voucher (that must be printed and presented on the spot), and only the owner(s)of the voucher are entitled to the listed service(s).
The traveller(s) can only participate in excursions on the day to which the voucher is valid.
Cancellation policy of excursion booking
The cancellation fee depends on the time of the cancellation: 30 days or more before departure: 10 EUR / booking (administration fee); 29 - 10 days before departure: 50% of the total booking amount; 9 - 0 days before departure: 100% of the total booking amount. If the traveller(s) fail to turn up on the day of departure CubaFiesta will charge a 100% of the total amount.
Insurance
No insurance is included in prices of excursions. You are liable for the cost of accidents and other damages, CubaFiesta cannot be held liable for any of these charges.
Travelling conditions, important information
It is your responsibility to abide by the law that regulates passports, visas, customs, currency, medical and other details. Your passport must be valid at least 6 months after your return. Should the passport expire within 6 months you are held responsible for any cost regarding this. Passports and any possible recommended vaccinations must be arranged by you.
Validating voucher of excursion, getting on the bus / taxi
Original vouchers of the group excursions/programmes must be collected by Client upon arrival to the Havana airport (in case of Havana city tours) or will be left at the reception of hotel by representative of provider (in case of catamaran tours at Varadero and Tropicana Show n Havana). Exact time (hour, minute) of departure will be written on original vouchers, you must pay attention to it and prepare for the programme according to this.
You must check the original voucher in every case (date, number of people, name of programme) and if it contains any data different from the confirmation sent by Cubafiesta, you must report it in written (email, text message) to Cubafiesta immadiately. If you fail to report the problem later neither provider nor Cubafiesta will be liable for any loss.
In case of private programmes it is sufficient to have the voucher issued by Cubafiesta. This will contain the confirmation number of provider and the time and spot of departure.
Voucher must be presented to the guide/tour leader/driver at the beginning of the excursion/tour/programme at the meeting point or on the spot (only in case of Tropicana Show in Havana).
In the case of a lost or stolen voucher or late arrival to the programme/meeting point, the provider of the excursion/tour/programme is entitled to refuse service.
Expenses incurred as a result of failing to use the voucher are your responsibility. No refund or compensation is available.
The traveller(s) can not modify the date or location of the paid service. Voucher is only valid for the services listed on it.
During the excursion
By re-confirming your booking you understand that CubaFiesta will accept no liability for any costs incurred due to a failure on your part to adhere to any rules or regulations set down by a service provider. Breaking the rules can cause the suspension of the service, and you are also responsible for any financial or moral damage!
Clients with no travel insurance must arrange compensation with provider of the excursion/programme at the spot. CubaFiesta is not liable in these cases.
In case of an excursion/programme provided contrary to its description a record must be taken down. Refund is only available in the amount recorded and signed by the provider company.
Valuables
All valuables and personal items are carried at your own risk. CubaFiesta is not responsible for these during the excursion!
Special situations
According to the civil rights neither party are responsible in case of a strike, war and political conflict, danger to the public, disaster, terror attack, international embargo and extreme weather conditions. If any sevice fails because of any of these reasons Cubafiesta is not liable and you can not ask for any refund or compensation, all extra costs have to be paid by you.
Complaints
In case of failure of third party no refund is available, neither CubaFiesta nor provider of the excursion/programme are liable for it.
In case of failure of the provider, the provider can offer another excursion/programme for you. If you accept it, later you can not claim any refund or compensation from neither provider nor Cubafiesta. A refund is only available if you report the failure of the excursion/programme in written (email, text message) to Cubafiesta on the original date of it. Provider must admit that they could not offer any other excursion/programme, they could not provide the booked excursion/programme on any other day during your stay or that you did not accepted the offered alternative excursion/programme. You must prepare a written report on the problem that must be signed by the representative of provider. The scanned report must be sent to Cubafiesta no later then 3 days after your return. If it is not possible to meet the representative Cubafiesta will issue a claim to provider in written on the day of the programme's failure and will refund the amount determined by provider in its written answer. Refund will be paid after your return.
Please consider that examination of your complaint can last for 3 - 6 months!
In case of a complaint
CubaFiesta aims to resolve all disputes directly with its clients. In the event that a resolution cannot be reached CubaFiesta agrees with the submission of the dispute to arbitration.
Other
Quality of the services must match the standards of the country of destination. This can be different in every country.
Pictures on pages of excursions are only illustrations. CubaFiesta is not liable for complaints resultant from this reason!
